These Terms of Service (the “Terms”) govern your access to and use of Portfolio Mentor (the “Service”) operated by Portfolio Mentor. By creating an account, accessing the Service, or clicking “I agree”, you agree to be legally bound by these Terms and by every document referenced from them, including our Privacy Policy, Cookie Policy, and Refund Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least sixteen years old to use the Service. By using the Service you represent and warrant that you meet this requirement, that all information you provide is accurate, that you have authority to enter into these Terms, and that you are not located in a jurisdiction where the Service is restricted by export control or sanctions law.
2. Account Responsibilities
- You are responsible for safeguarding your password and for any activity taken under your account, whether or not authorized by you.
- You may not share your account, sublicense it, or transfer it without our written consent.
- Notify us immediately at [email protected] if you suspect unauthorized access. We will help you secure the account and (if needed) reverse fraudulent charges.
- You are responsible for keeping your account email and recovery information current. We are not liable for messages or refunds we cannot deliver because account contact data is stale.
3. The Service
The Service provides AI-powered architecture portfolio reviews, including overall scoring, ten-criterion category breakdowns, page-by-page analysis, firm and program match recommendations, and prioritized improvement suggestions. Reviews are advisory and informational only. The Service does not guarantee any specific career outcome (interview, offer, admission, promotion). We make no representation that any score correlates with any third-party hiring or admission decision.
4. User Content
You retain full ownership of all portfolios, drawings, images, and other content you upload (collectively, “User Content”). By uploading User Content, you grant us a limited, non-exclusive, worldwide, royalty-free license to:
- Process the User Content through our AI systems for the sole purpose of generating your review.
- Store the User Content securely so you can access your review history.
- Display the User Content back to you in your account dashboard and in the rendered review report.
- Create transient cache copies, thumbnails, and indexed metadata strictly for performance.
This license terminates automatically when you delete the User Content or your account. We do not claim ownership, we do not use User Content to train any AI model without your separate, granular consent, and we do not publish, syndicate, or sell User Content under any circumstance.
You represent that you own or have the right to use all User Content and that the User Content does not infringe any third-party copyright, trademark, trade secret, privacy, or publicity right.
5. Acceptable Use
You agree not to:
- Upload content you do not own or do not have permission to share, including content protected by NDA you did not authorize.
- Upload illegal, defamatory, hateful, or infringing material.
- Attempt to reverse-engineer, scrape, mass-download, or otherwise abuse the Service.
- Use the Service to build a competing product, train a competing model, or benchmark against the Service for that purpose.
- Resell, syndicate, or grant access to the Service without our written agreement.
- Probe, scan, or test the vulnerability of the Service except through our published bug-bounty program.
- Send unsolicited commercial messages through any feature of the Service.
We may suspend or terminate access if we have reasonable grounds to believe you have breached this section. Where the conduct is criminal, we will cooperate with the relevant authorities.
6. Subscriptions and Billing
Paid plans renew automatically at the end of each billing period at the then-current rate. You can cancel at any time from your account settings; cancellation takes effect at the end of your current billing period and you continue to have full access until then. Refunds are governed by our Refund Policy. Prices and applicable taxes will be displayed during checkout. We may change pricing on prospective renewals with at least thirty days notice; the new rate applies only to renewals after the notice period.
7. Intellectual Property
All software, design, branding, written content, AI weights, prompt libraries, and rubric definitions used by the Service are the exclusive property of Portfolio Mentor or our licensors and are protected by copyright, trademark, trade secret, and other intellectual-property laws. You receive a limited, revocable, non-transferable license to use the Service for its intended purpose. Nothing in these Terms transfers any ownership.
8. Disclaimers
The Service is provided “as is” and “as available” without any warranty of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that:
- Reviews will result in any specific career outcome.
- The Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
- AI-generated feedback is free from errors of judgment.
You should treat AI feedback as a useful second opinion, not as professional career counseling, employment advice, or admissions counseling.
9. Limitation of Liability
To the maximum extent permitted by law, the total liability of Portfolio Mentor arising out of or relating to these Terms or the Service is limited to the amount you paid us in the twelve months preceding the event giving rise to the claim. We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, or business interruption, even if advised of the possibility of such damages. Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for certain damages, so some of the above limitations may not apply to you.
10. Indemnification
You agree to defend, indemnify, and hold harmless Portfolio Mentor, its officers, directors, employees, and agents from any claim, damage, loss, or expense (including reasonable attorneys fees) arising out of your User Content, your breach of these Terms, your violation of applicable law, or your infringement of any third-party right.
11. Termination
We may suspend or terminate your access to the Service if you breach these Terms or if we are required to by law. You may terminate your account at any time. Upon termination, your data is handled per our Privacy Policy. Sections of these Terms that by their nature should survive termination (ownership, indemnity, limitation of liability, dispute resolution) survive termination.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the jurisdiction in which Portfolio Mentor is registered, without regard to conflict of law principles. The parties first agree to negotiate in good faith for at least thirty days before filing any claim. If unresolved, disputes will be resolved exclusively in the courts of that jurisdiction unless mandatory consumer-protection law in your country of residence provides otherwise.
13. Changes
We may update these Terms from time to time. We will notify you of material changes at least thirty days in advance via email and an in-app banner. Non-material changes (typo fixes, clarifications) may be applied immediately and will be summarized in the revision log at the bottom of this page. Continued use of the Service after the effective date constitutes acceptance.
14. Miscellaneous
If any provision of these Terms is held invalid, the remaining provisions remain in full effect. Our failure to enforce any right or provision is not a waiver of that right. These Terms constitute the entire agreement between you and us regarding the Service and supersede any prior or contemporaneous agreement on the same subject.
